David Lin is a seasoned commercial and technology attorney whose combination of Big Law litigation depth, in-house general counsel experience, and an engineering background makes him one of the most versatile lawyers in his field. With more than 15 years of experience across technology, energy, infrastructure, and real estate, David has counseled clients ranging from global Fortune 500 companies to high-growth emerging businesses, bringing the same rigor, strategic thinking, and commercial judgment to every engagement.
David’s practice centers on general counsel and transactional work—commercial contracts, SaaS and licensing agreements, R&D partnerships, IP strategy, and the full range of legal challenges that growing technology companies face. What distinguishes him is the litigation instinct he carries into every deal: After years handling high-stakes patent disputes at Winston & Strawn on behalf of leading networking, semiconductor, and interactive entertainment companies, David reads contractual risk with the precision of a trial lawyer. That combination of transactional skill and litigation fluency is particularly valuable in fast-moving industries where the legal landscape is still evolving, and the cost of getting a deal wrong can be enormous.
David’s track record reflects the breadth and quality of his work across litigation and transactional matters. At Winston & Strawn, he represented some of the world’s leading technology companies in a wide range of complex disputes, including patent infringement, trade secret defense, breach of contract, and ITC investigations, as well as IP enforcement matters on behalf of major telecommunications and media companies. For example, he helped invalidate a patent portfolio before the Patent Trial and Appeal Board on behalf of three major interactive entertainment companies, secured summary judgment wins in the parallel district court proceedings, and led multi-front defense campaigns for major networking and semiconductor clients in the Eastern District of Texas, consistently achieving favorable resolutions. Beyond litigation, David advised on technology-focused transactional matters, including M&A due diligence and IP strategy for technology acquisitions. Today, as General Counsel of a quantum computing software company operating at the frontier of high-performance computing, he structures and negotiates complex commercial and R&D agreements with some of the world’s most sophisticated technology partners.
Outside the office, David serves as a board member of San Marino National Little League and is a guest lecturer at Loyola Marymount University, where he shares hard-won lessons from practice with the next generation of lawyers. Experience
On behalf of three major video game publishers, successfully petitioned the Patent Trial and Appeal Board to invalidate a portfolio of networking patents asserted by a patent assertion entity. Subsequently obtained summary judgment in favor of two of the clients in parallel district court litigation, defeating six asserted patents.
On behalf of a major interactive entertainment company, publisher of globally recognized titles including a leading battle royale franchise, obtained a complete victory at trial in California Superior Court against a major international gaming competitor over the enforceability of a settlement agreement.
On behalf of a leading networking and communications technology company, defended more than a half-dozen patent infringement actions brought by patent assertion entities in various jurisdictions around the country, including the Eastern District of Texas and the District of Delaware, winning claim construction on multiple occasions and achieving favorable resolutions across cases spanning networking, cloud, and communications technologies.
Served as General Counsel of a quantum computing software company, negotiating high-value SaaS, infrastructure, and R&D collaboration agreements with major global technology partners supporting high-performance computing and large-scale system deployment, successfully guiding the company through a multi-million dollar fundraising round, and overseeing commercial operations and strategic legal initiatives across multiple jurisdictions.
On behalf of a leading smart home and access control technology company, tried a multi-patent case through full trial before the International Trade Commission and, on rehearing, successfully obtained a finding of non-infringement.
