
Overview
For more than two decades, Jean Mooney has applied the value ingrained in her as a child that “details matter” to her litigation practice.
Her methodical and detailed approach to legal analysis translates into effective, persuasive briefing on diverse legal topics, including data privacy, Article III standing, choice of law, non-disclosure agreements, and RICO. And her ability to identify the strengths and weaknesses of her clients’ claims and defenses enables her to resolve disputes efficiently and effectively.
Jean’s practice focuses on class action litigation and complex civil litigation. She regularly defends corporations in consumer class actions across the country and has assisted in defeating class actions involving allegations under California’s Unfair Competition Law, Consumers Legal Remedies Act, False Advertising Law, and state warranty laws. With her extensive experience defending claims alleging violations of California’s and other states’ consumer protection laws, Jean is well-versed in the most effective defenses of such actions.
In the last few years, Jean successfully opposed class certification of warranty claims under California and Illinois law and secured dismissal of a subset of class claims for fraudulent omission and violation of the Illinois Consumer Fraud and Deceptive Business Practices Act on summary judgment. She also assisted in securing dismissal of a RICO claim on standing grounds on behalf of a national retail chain.
While living in Taiwan for two years, Jean honed her Mandarin skills and discovered a love for baking. She spends her free time perfecting her scone recipe and planning the next international adventure with her family.

Experience
Represented automobile company in putative nationwide class action in which Plaintiff alleged claims for breach of express and implied warranties and violation of the Magnuson-Moss Warranty Act based on allegedly defective vehicle component. Shortly after submitting a pre-motion letter to the Court setting forth the bases for Defendant’s motion to compel individual arbitration or, in the alternative, to dismiss, the case settled favorably.
Represented social media platform in putative class action alleging violation of the Video Privacy Protection Act. After months of litigation, the matter was resolved on an individual basis.
Responded to CLRA letter alleging claims of non-functional slack fill in client nutrition company’s product, which ultimately resulted in a favorable settlement.
Obtained dismissal with prejudice of RICO class action against retail chain. The Court adopted Defendant’s argument that Plaintiffs lacked Article III standing because they failed to allege that their alleged injuries were traceable to Defendant’s conduct.
