Will Delgado Speaks to Bloomberg Law on Trademark Law Issues in Peloton, Mad Dogg Athletics Case

Will Delgado was recently quoted in Kyle Jahner’s Bloomberg Law article “Popular Brands Work to Keep Trademarks as Peloton Strikes at One.” The article discusses the tools that brands have available to control and retain their trademarks. Will commented on the significance of trademarked terms to consumers.

“There’s no formula or ‘magic number’ for what share of consumers need to recognize an oft-used mark as a brand, trademark attorney,” Will said. “It’s more art than science. When you say the mark, does the public believe that you are referring to the good itself, rather than the source?”
