Daily Journal Names Megan O’Neill Among California’s Top Women Lawyers

The firm is pleased to announce that the Daily Journal has named DTO partner Megan O’Neill to its 2023 list of “Top Women Lawyers” in California. This is Megan’s second time being selected to the special issue, which honors California women who have achieved significant victories for clients and are considered leaders in their respective fields.

Megan is a seasoned litigator and a leader in the class action space, regularly defending Fortune 500 companies in consumer class actions alleging unfair competition, false advertising, and products liability. She also has significant experience litigating complex commercial disputes and intellectual property claims involving trademark infringement.

The Daily Journal’s profile of Megan in this issue highlighted her representation of client Walgreens in the case of Lowe v. Walgreens Boots Alliance, Inc., a putative class action in which the plaintiff sought to represent consumers who allegedly paid a “pink tax” on women’s Minoxidil because the product was priced higher than the men’s version. DTO successfully argued that the false advertising claims were preempted and that California’s Unruh Act did not cover pricing differences in products. The court granted Walgreens’ motion to dismiss in its entirety.

The Daily Journal also recognized Megan’s continued work on behalf of Unilever, including in Dolce v. The LIV Group, a putative class action alleging false advertising filed against Unilever subsidiary Liquid IV, which was successfully resolved early in the case before expensive discovery.

In addition to these major wins, Megan’s write-up spotlighted DTO’s value proposition to clients: “A lot of our success is in knowing how to present our arguments to persuade the court that the plaintiff is overreaching. We downsize cases.”

The profile also noted DTO’s roster of 20 attorneys as well as its recent expansion into New York to meet case demands — a strategic move that has paid off already. “We’re very busy,” Megan told the Daily Journal. “It’s been gangbusters. My practice the last two years has been even more class action-heavy with new and repeat customers.”

Megan was also recently recognized by the Silicon Valley Business Journal as a “Woman of Influence” in 2022. As an established thought leader in the class action arena, she frequently speaks on related topics at legal seminars and conferences.
