Casey Bryan and Isabella Chilingaryan’s “Foreign Jurisdiction Cases” Featured in CLA Real Property

A case summary co-authored by Casey Bryan and Isabella Chilingaryan, entitled “Foreign Jurisdiction Cases of Note to California Practitioners” was featured in California Lawyers Association’s (CLA) Real Property Law Section on Monday, March 20, 2023.

In the first case summary, Casey and Isabella highlight an appellate ruling that affirmed the enforceability of a Landlord’s estoppel certificate where the court found that the Tenant’s prior knowledge of certain items included in the Landlord’s common area maintenance costs prevented the Tenant from not paying the disputed costs since the estoppel certificate included clear language regarding Tenant having no defenses or offsets to the costs.  The second case features a Lending Law case that went to the New Jersey Supreme Court where the defendant, a homeowner, unsuccessfully challenged a bank’s action to foreclose on his mortgage because the original note was lost by the original note holder prior to a lost note affidavit being assigned to the bank.
